Cancellation/Refund Policy

At Psalms Properties, we understand that sometimes circumstances change and you may need to cancel a contract. Our cancellation and refund policy is designed to be fair and transparent. Please note that agency fees and retainers are non-refundable. However, you are free to cancel at any time. We reserve the right to cancel a contract after signing if the terms are no longer favorable and we are within our legal rights to  do so. Additionally, we may cancel a contract if the other party is physically incapable of fulfilling their obligations, including and not limited to injury or permanent incapacitation, or if they have failed to fulfill their obligations or acted in a way that was inconsistent with the rules set out by the contract or agreement.

At Psalms Properties, we want you to be completely satisfied with your merchandise purchase. If for any reason are not satisfied, we offer refunds on unworn and undamaged items. Please note that a restocking fee may apply. Customers are responsible for return shipping costs. We strive to make our cancellation and refund policy as fair and transparent as possible.

No Unlawful or Prohibited Use/Intellectual Policy

Indemnification:

You agree to indemnify, defend and hold harmless Psalms Pros, it officers directors, employees, agents and third parties for any losses, costs, liability and expenses ( including any reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of the third party, or your violation or any applicable laws, rules or regulations. Psalms Pros reserve the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Psalms Pros in asserting any available defense. 

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provision hereof, whether in contract, tort of other wise at law or in equity for damages or any other relief, then such dispute should be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutual agreed upon by the parties. The arbitration award shall be final, and judgment should be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concern, These Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s  fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of  this provision. The entire dispute, introducing the scope and enforceability of the arbitration shall be determined by the Arbitrator. The arbitrator provision shall survive the termination of these Terms and Conditions. 

Class Action Waiver 

Any arbitration under these Terms and Conditions will take place on an individual basis, class arbitration and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDINGS, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTIONS AGAINST EACH OTHER. Further, unless you and Psalms Pros agree otherwise, the Arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form or a representative or class proceeding. 

Changes to Terms 

Psalms Pros reserves the right, in sole discretion, to change the Terms under which https://AGreatAgency.xyz  is offered. The most current version of the Terms will supersede all previous versions. Psalms pros encourage you to periodically review Terms to stay informed of our updates.
